Embrace Club LLC — Privacy Notice

Embrace Club LLC takes your privacy seriously. This notice explains what data we collect from users of our websites, apps, and other services. This includes both professionals offering their services ("Embracers") and clients seeking services ("Clients"). For information about employee or job applicant data, a separate policy applies.

When you create an account or use Embrace Club, you will be asked to agree to this Privacy Notice and our Terms of Service. This notice explains how we collect, use, and protect your information so you can make an informed decision.

Users are responsible for safeguarding their own important and private information. We cannot guarantee the complete protection of user information and shall not be held liable for any failure to protect the privacy of electronic mail or other information transferred through the Internet or any other network utilized by users.

We are committed to respecting user privacy and ensuring responsible data management. We do not sell your personal information to data brokers or unrelated third parties for their own commercial purposes. We do use third-party advertising and analytics services (such as Google Ads, Meta Pixel, and Google Analytics) to market our platform and understand how it is used. Under California law, this activity may be considered "sharing" of personal information. California residents have the right to opt out — see Section 11 below.

1. Understanding How We Collect Your Information

The data we collect from users is primarily utilized to enhance the user experience, improve the functionality and performance of our website, and facilitate the services we offer through the Embrace Club platform.

When you create an Embrace Club account, you agree to the data practices described in this notice. For certain uses — such as marketing communications and advertising-related tracking — you may have additional choices, which are described in Sections 4, 5, and 11.

This document explains how we gather information about you. We collect it in three main ways:

A. Information You Give Us Directly
  • Profile details like name, address, phone number, and gender.
  • Session scheduling details for both Clients and Embracers.
  • Contact information from your device or email if you allow us access.
  • Content you post publicly on the platform.
  • Sign-up information for newsletters or updates.
  • Identity verification documents (such as government-issued ID), only when we have specific reasons to verify a user's identity — for example, to investigate suspected fraud, resolve disputes, respond to safety concerns, or confirm account ownership. We do not routinely collect ID from all users. When we do request ID, the documents are accessed only by authorized Embrace Club staff and are not shared with other users.
B. Information Collected Automatically
  • Web server logs that track your device and browsing activity.
  • Location information based on your IP address or from your mobile device (with permission).
  • Cookies and similar tracking technologies that monitor your usage patterns.
  • Unique identifiers associated with your mobile device.
C. Information from Outside Sources
  • Details from third-party information providers.
  • Publicly available information about you.
  • Information from social media platforms you connect to Embrace Club (based on your privacy settings on those platforms).
A note about payments:

Embrace Club does not process payments between Clients and Embracers. Each Embracer handles their own payments directly with their Clients using their own preferred payment methods. As a result, Embrace Club does not collect or store payment card numbers, bank account information, or other financial transaction details. Any payment-related information you share with an Embracer is governed by that Embracer's own privacy practices, not this notice.

2. How We Use Your Information

We collect and process personal information based on your agreement to this notice when you create an account, our need to provide the services you've requested, our legitimate business interests in operating and improving the platform, and our legal obligations. Where required by law, we obtain your specific consent for particular uses (such as marketing communications). However, users should be aware that some information submitted on the website may be publicly accessible in order to promote transparency and enhance the safety of our platform's users.

We use the information we collect about you for a variety of reasons, all explained in our privacy policy or directly communicated to you through the platform. Here's a breakdown of our main uses:

  • Account Management: We use your information to set up your account, verify your phone number, and ensure smooth delivery of our services.
  • Communication: You'll receive transactional messages from us, including confirmations, invoices, updates, security alerts, and support information related to your account. We may also use this information to respond to your inquiries and provide customer service.
  • Marketing: We may send you news about our products and services.
  • Service Improvement: We use your information to operate, maintain, and improve our platform. This includes testing, updating, monitoring, and troubleshooting functionalities.
  • Security and Legal Compliance: We use your information to prevent fraud and illegal activity, unauthorized access to data, and to comply with various legal and institutional requirements.
  • Contract Enforcement: We may use your information to enforce agreements made with our Clients.
  • Dispute Resolution: We may use your information to investigate and resolve any disputes or security issues, and to enforce our Terms of Service.
  • Other Business Purposes: We reserve the right to use your information for any other lawful and legitimate business reasons.

3. When We Share Your Information

We share your information in certain situations, as outlined in our privacy policy. Here's a breakdown of when we might share your data:

  • With Other Users: Information is shared with other users on the platform, but only as needed to facilitate the service itself. For instance, your information as a Client might be shared with your chosen Embracer for scheduling and communication purposes.
  • With Affiliated Companies: We may share your information with companies we own or control, or those under common ownership. These affiliates will use your information under the same guidelines as our privacy policy.
  • With Service Providers: Third-party companies that assist us with tasks like IT support, accounting, or analytics may receive your information, but only to perform the specific service requested by us.
  • During Business Transfers: In the event of a merger, acquisition, or other business transaction, your information may be disclosed to the other party involved. This also applies to bankruptcy or similar proceedings.
  • For Legal Compliance and Safety: We may disclose your information if required by law, subpoena, or if we believe it's necessary to comply with regulations, enforce our Terms of Service, protect our platform's security, or safeguard our rights and the safety of our users or others. This may also involve sharing information with government authorities for tax or legal purposes.
  • With Your Consent: We may share your information with other entities, but only if we disclose this to you at the time of collection or obtain your explicit consent.

It's important to note that we may also share anonymized or de-identified data that cannot be reasonably used to identify you as an individual.

4. Analytics and Advertising

We use third-party analytics and advertising services to understand how our platform is used and to market our services. As noted in our privacy commitment, we do not sell your personal information to data brokers, but we do "share" certain information with advertising partners as that term is defined under California law.

  • Google Ads: We use Google Ads to advertise our services and to show relevant ads to people who have visited our platform. This includes remarketing, which means Google may show you Embrace Club ads on other websites you visit.
  • Meta Pixel (Facebook and Instagram): We use the Meta Pixel to measure the effectiveness of our ads on Facebook and Instagram and to show relevant ads to people who have visited our platform.
How These Services Work

These services use cookies and similar tracking technologies to collect information about your activity on our platform and other websites you visit. They may combine this information with data they collect from other sources to build a profile of your interests and show you targeted ads.

Your Choices

5. Managing Your Information on Embrace Club

We offer you some control over your personal information:

  • Updating or Deleting Your Information: Contact us directly at info@embraceclub.com if you want to review, change, or delete your information. However, we may not be able to fulfill all deletion requests.
  • Controlling App Permissions: You can manage your device's settings to control how the Embrace Club app accesses your information. This might include location, camera, address book, and other functionalities.
  • Unsubscribing from Emails: You can opt out of promotional emails from us by clicking the "unsubscribe" link within those emails. Note that you cannot unsubscribe from essential service-related communication.

6. Adults Only — Age Requirements

Embrace Club is an adult-only platform. Our services involve professional touch and require informed adult consent. By using Embrace Club, you represent that you are at least 18 years old.

We do not knowingly allow anyone under 18 to create an account, book sessions as a Client, or offer services as an Embracer. If we become aware that a user is under 18, we will close the account and delete the associated personal information.

Children's Privacy (Under 13):

In addition to our adult-only policy, we comply with the U.S. Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at info@embraceclub.com and we will delete the information.

California Minors (Under 16):

Under California law, minors under 16 who have inadvertently posted content on our platform have the right to request its removal. Since our platform is restricted to adults, this should not arise — but if it does, contact us at info@embraceclub.com.

7. Following Links on Embrace Club

The platform may contain links to other websites or social media. These external sites have their own privacy policies, and we are not responsible for their practices. We recommend reviewing those privacy policies before following any links.

9. Updates to Our Privacy Notice

We may occasionally update our privacy policy to reflect changes in our business practices. We recommend you revisit this page periodically to stay informed. We will notify you of any significant changes and update the "last updated" date at the top of the policy. If you disagree with the updates, you can stop using our service. Conversely, continued use after the update signifies your acceptance of the changes.

10. How We Protect Your Information

We take the security of your information seriously and implement reasonable safeguards designed to protect it from unauthorized access, disclosure, alteration, or destruction. These safeguards include:

  • Encryption in transit: All data transmitted between your device and Embrace Club is encrypted using industry-standard TLS (the "https" you see in your browser).
  • Encryption at rest: Personal information stored in our systems is encrypted on disk by our infrastructure providers.
  • Access controls: Access to personal information is limited to authorized Embrace Club personnel who need it to perform their roles, and is protected by strong authentication.
  • Trusted providers: We use established service providers for hosting, email, and analytics, each of whom maintains their own security practices and certifications.

Despite these measures, no system is completely secure. We cannot guarantee absolute security of information transmitted over the internet or stored electronically. If you have concerns about the security of your account or believe your account has been compromised, contact us immediately at info@embraceclub.com.

Data Breach Notification:

In the event of a data breach affecting your personal information, we will notify affected users and applicable regulatory authorities as required by law.

11. Your California Privacy Rights

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). This section explains those rights and how to exercise them.

Categories of Personal Information We Collect

In the past 12 months, we have collected the following categories of personal information from California residents:

  • Identifiers: name, email address, phone number, IP address, account ID
  • Customer records: billing address (if provided for service-related purposes)
  • Commercial information: booking history, services purchased
  • Internet or network activity: browsing history on our platform, interaction with our website
  • Geolocation data: general location derived from IP address
  • Inferences: preferences and interests drawn from your activity
  • Sensitive personal information: account login credentials; booking history may reveal information about your wellness activities

Your Rights Under California Law

As a California resident, you have the right to:

  • Know what personal information we have collected about you, including the categories of information, sources, purposes, and third parties we've shared it with.
  • Access a copy of the specific pieces of personal information we have about you.
  • Delete the personal information we have collected from you, subject to certain legal exceptions (for example, we may need to keep records for tax, legal, or security purposes).
  • Correct inaccurate personal information we have about you.
  • Opt out of "sharing" your personal information for cross-context behavioral advertising (such as the advertising activities described in Section 4).
  • Limit the use of sensitive personal information to only what is necessary to provide our services.
  • Not be discriminated against for exercising any of these rights. We will not deny you services, charge you different prices, or provide a lower quality of service because you exercised your privacy rights.
How to Exercise Your Rights

To submit a request, contact us at info@embraceclub.com with the subject line "California Privacy Request" and let us know:

  • Which right you want to exercise
  • Your full name and the email address associated with your Embrace Club account
  • Enough detail for us to understand and respond to your request

You may also opt out of sharing for advertising by using the "Do Not Sell or Share My Personal Information" link in our website footer.

How We'll Respond
  • We'll confirm receipt of your request within 10 business days.
  • We'll respond to your request within 45 days. If we need more time, we'll let you know and may extend by an additional 45 days.
  • Before fulfilling certain requests (especially access and deletion), we'll verify your identity by confirming information you've provided to us. This is to protect your data from unauthorized requests.
  • If we cannot fulfill your request, we'll explain why.
Authorized Agents

You may designate an authorized agent to make a request on your behalf. We'll require written proof of the agent's authority and may verify your identity directly.

12. How Long We Keep Your Information

We keep your personal information only as long as we need it for the purposes described in this notice, or as required by law. The specific retention period depends on the type of information and the reason we collected it.

Account information (such as your name, email, profile details): We retain this for as long as your Embrace Club account is active. If you close your account or request deletion, we will delete or anonymize this information within 90 days, unless we are required to retain it for legal, tax, or security reasons.

Booking records: We retain booking history (such as dates, services booked, and the parties involved) for up to 7 years after a booking, to resolve disputes, enforce our agreements, defend against legal claims, and meet applicable record-keeping requirements.

Marketing and communications data: We retain your email and newsletter preferences until you unsubscribe or withdraw consent, after which we keep a minimal record to ensure we don't accidentally re-contact you.

Analytics and server logs: Standard web server logs and analytics data are retained for up to 26 months, in line with Google Analytics defaults.

Support and customer service communications: We retain inquiries and support messages for up to 3 years for reference and quality purposes.

Inactive accounts: Accounts that have not been used for an extended period may remain in our system. If you no longer want your account or data retained, you can request deletion at any time by contacting us at info@embraceclub.com.

When determining specific retention periods, we consider: the nature and sensitivity of the information, the purposes for which we use it, applicable legal and regulatory requirements, and whether we can achieve our purposes through other means (such as anonymized data).

Once a retention period expires, we either delete the information or anonymize it so it can no longer be associated with you.
